RELEASE AND WAIVER OF LIABILITY ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

Please carefully read the following terms and conditions relating to your participation in Duke Ferguson's Unleashed Potential NePoPo® Workshop (the "Workshop"), which is operated by The Happy K-9, Inc ("Promoter"). By registering for the workshop at the location ("The Happy K-9, Inc"), you (the "Attendee") signify your acceptance of and obligation to these terms and conditions. If you have objections to the following Terms and Conditions, you should not register for or attend the workshop.

IN CONSIDERATION of being able to participate in the entitled workshop, the undersigned:

HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the workshop provider, promoter, other participants, owners and leasees of the premises used to conduct the workshop and each of them, or their agents and employees, all for the purpose herein referred to as "Releases," from all liability to the undersigned for any and all loss or damage and any claim or demands therefore on account of injury to the person or property or resulting in the death of the person or property of the undersigned arising out of or relating to the workshop, whether caused by the negligence of the Releases or otherwise. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releases and each of them from any loss, liability, damage or cost they may incur arising out of or related to the workshop, whether caused by the negligence of the Releases or otherwise.

HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE, INCLUDING DEATH, arising out of or related to the workshop, whether caused by the negligence of Releases or otherwise.

HEREBY ACKNOWLEDGES THAT THE ACTIVITIES OF THE WORKSHOP MAY BE DANGEROUS. This event involves the participation of working with animals that may be subject to unexpected conditions. When working with animals, there is a risk of serious injury and /or death and/or damage to persons or property. 

HEREBY AGREES THAT THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT EXTENDS to all acts of negligence by the Releases and is intended to be as broad and inclusive as is permitted by the laws of the Province/State in which the Seminar is conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME. I INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. NO PICTURES OR VIDEOS ALLOWED WITHOUT PERMISSION.

NO CAMERAS, PHONES, VIDEO CAMERAS OR ANY OTHER RECORDING DEVICES ARE ALLOWED DURING THE SEMINAR. 

 VIDEO WAIVER AND RELEASE FORM

I hereby give my full permission for the use of my name, picture, image, likeness, actions, voice, or other personally identifiable information, in whole or in part, individually or in conjunction with other images. I waive all rights of privacy or compensation, which I may have in connection with such use of my name, picture, image, likeness, actions, voice or other personally identifiable information. I grant Duke Ferguson, his business, and his affiliates the unrestricted right to use my name, picture, image, likeness, actions, voice or other personally identifiable information associated with such video submission in all formats, media and all manners, including composite or al­tered representations, for advertising, trade or any other lawful purposes. I waive any right to inspect or approve the finished version(s), including written copy that may be created in connection with the video production, editing and promotion therewith.

I am over 18 years of age, have read this release, and am fully familiar with its contents.

Attendee Conduct 

Promoter requires all Attendees to be respectful and professional to our staff, location hosts, speakers, and other attendees throughout the workshop, even during non-scheduled downtime and breaks. The Promoter reserves the right to ask Attendee and/or their guests to leave immediately should they be deemed rude, uncooperative, unprofessional, intoxicated, or possessing any illegal substance. In such case, the Attendee's tuition/fees for the workshop will not be reimbursed under any circumstances, and they will not receive any future products, services, or correspondence from Promoter. Attendee will also not receive any of our advertised bonuses or any other written or implied guarantee.

Covid Liability Waiver

The novel coronavirus, COVID-19, was declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is spread from person to person in the air, with contact with others, and/or by contact with contaminated surfaces and objects. People reportedly can be infected and show no symptoms, spreading the disease. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. Producer cannot prevent you from becoming exposed to, contracting, spreading, or becoming sick by COVID-19 while traveling to or attending the Event or any of its activities. It is not possible to prevent against the presence of the disease. Therefore, if you choose to attend the Event, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19 and any of its variants.

ASSUMPTION OF RISK: By signing this Event Release, I acknowledge I have read and understood the above warning concerning COVID-19. By attending, I unconditionally and solely accept the risk of being exposed to, contracting, and/or spreading COVID-19, and I hereby forever release and waive my right to bring suit against any attendee of the Event, as well as the Producer and its owners, officers, directors, managers, officials, trustees, agents, vendors, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to attending the Event. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, sickness, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. 

While we take every possible measure to ensure Attendee safety at the Workshop, we cannot control everything. For this reason, Attendee is legally responsible for their safety and behavior and agrees to, and is held legally liable to, the following statements: 

I, the willing Attendee of the Seminar, hereby accept all risk to my health and of my injury or death that may result from participating in the Seminar and I hereby release Promoter, Duke Ferguson, and their contractors, sponsors, and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Workshop, whether caused by the negligence of the Promoter, its governing board, officers, employees, or representatives, or otherwise. I further agree to indemnify and hold harmless Promoter, Duke Ferguson, and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the Workshop. Under no circumstances will Promoter or Duke Ferguson or their assigns be held liable for my injury or death or any loss or damage of my personal belongings resulting from my participation in the Workshop. Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in the Workshop, I consent to such treatment. I acknowledge, and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. 

Commitment to Be Free of COVID-19 Symptoms  

I agree that I should be free from COVID-19 symptoms, without medication, before I enter upon the Premises where the Unleashed Potential Dog Training Workshop is held. I will not enter the Premises or participate in a workshop dog training activity if I experience, or have experienced symptoms of COVID-19 or another Illness (such as cough, fever, fatigue, aches, loss of taste or smell, sore throat, shortness of breath, vomiting or diarrhea), have a confirmed or suspected case of COVID-19 or another illness.

The information contained in or made available by the Promoter, Duke Ferguson, or any third-party through the workshop or their websites or services cannot replace or substitute for the services of trained professionals in any field of, but not limited to, mental, financial, medical, psychological, or legal fields. Promoter does not offer any professional medical, financial, therapeutic, or legal advice, and none of the information contained in the workshop should be confused as such advice. Neither Promoter, Duke Ferguson, nor their assigns, sponsors, speakers, partners, contractors, or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary, or other damages to the Attendee or the Attendee's business, including economic loss, that may result from participation in the workshop or the use of, or the inability to use, the materials, information, or strategies communicated through the workshop or any products or services provided according to the workshop, even if advised of the possibility of such damages. Under no circumstances, including but not limited to negligence, will Promoter or Duke Ferguson be liable for any special or consequential damages that result from Attendee's participation in the workshop. To be clear: You, the Attendee, alone are responsible and accountable for your decisions, actions, and results in life, and by your participation in our workshop, you agree not to attempt to hold us, the Promoter or Duke Ferguson, liable for any decisions, actions, or results that you make or experience in business or life due to your participation in this workshop at any time, under any circumstance.

Attendee hereby understands and agrees not to record, duplicate, distribute, teach or train from the Seminar materials in any manner whatsoever without the express written permission of Promoter.

 All content, images, and recordings generated at the Seminar are exclusively owned by Promoter.

Privacy Policy and Terms of Use
